There is hereby adopted and incorporated by reference, for the purpose of establishing rules and regulations for the construction, alteration, removal, demolition, equipment, use and occupancy, location and maintenance of buildings and structures, the Uniform Building Code, 1997 Edition as recommended by the International Conference of Building Officials, such code being made as part of the ordinances and code of the city as if the same had been set out in full herein, all as authorized and in the manner prescribed by K.S.A. 12-3009 through 12-3012 including amendments thereto. One copy of the Uniform Building Code marked or stamped “Official Copy as Incorporated by the Code of the City of Enterprise,” and shall be filed with the city clerk to be open and available to the public at all reasonable hours of business. Any person violating any provision of such code, upon conviction, shall be punished as provided in section 1-117 of this code.

No building shall be erected, enlarged, altered, removed or demolished within the city without a permit therefore from the code enforcement officer, who shall require a plan of the proposed work, together with a statement of the materials to be used in writing, and obtaining a formal permit to proceed with such work. Where it appears to the code enforcement officer that the proposed work is in violation of the provisions of the Uniform Building Code incorporated in section 4-101 of this code and in effect at the time of the application, the permit shall be denied. The applicant may appeal this decision to the governing body. Such permit shall be issued upon the payment of a permit fee and conditioned upon the compliance with the provisions of this article. Fees for building permits shall be based on the estimated cost of the work to be done and shall be as follows:
(a) First $1,000: $10.00
(b) For each additional $1,000 or fraction thereof: $1.00.
