It shall be unlawful for any person, firm, corporation or other entity to park, house, store or permit to remain upon any public street, alley, park, or upon private property within the City of Enterprise, Kansas, any other vehicle or trailer or container which shall be sued to transport hazardous materials, except while such vehicle shall be attended at all times by the driver thereof or other responsible party while loading or unloading. Provided further however, that any such vehicle, trailer or container may be temporarily parked within the city for a period not to exceed one hour.

As used in this article, the term hazardous material shall mean any substance that due to its nature may cause injury upon contact therewith, or shall be extremely volatile or flammable or radioactive.

It shall be unlawful to store or use any container designed to hold more than 15 gallons of propane, LPG, or butane in any area of the city designated by the current zoning code as R-1, R-2, or R-3.

The provisions of this article shall not apply to any container which shall have a capacity of 150 gallons or less which shall be used for the purpose of supplying fuel for the vehicle on which it is mounted. Except further that these provisions shall not apply to vehicles, trailers, containers or tanks containing anhydrous ammonia or other material primarily used by farmers for fertilizer purposes when such vehicles, trailers, containers or tanks are parked or housed upon property designated for the placement of such vehicle or trailer, container or any by any farmers cooperative, elevator company or farm supply store located within the city limits in a properly zoned area.
