A CHARTER ORDINANCE EXEMPTING THE CITY OF ENTERPRISE, KANSAS, FROM THE PROVISIONS OF KANSAS STATUTES ANNOTATED 15-106, REGARDING QUORUM REQUIREMENTS; PROVIDING SUBSTITUTED PROVISIONS ON THE SAME SUBJECT; AND REPEALING CHARTER ORDINANCE NO. 12 IN ITS ENTIRETY.

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF ENTERPRISE, KANSAS:

Section 1: Exemption. The City of Enterprise, Kansas, by virtue of the power vested in it by Article 12, Section 5 of the Constitution of the State of Kansas, hereby elects to and does exempt itself and make inapplicable to i! Kansas Statutes Annotated 15-106 which applies to this City but does not apply uniformly to all cities.

Section 2: Regular and Special Meetings. Regular meetings of the Council shall be held at such times as shall be prescribed by ordinance, but not less than once each month. Special meetings may be called by the mayor or acting mayor at any time, or on the written request of three members of the city council, specifying the object and purpose of such meeting which request shall be read at a meeting and entered at length on the journal. In all cases it shall require three (3) of the five (5) Council members elect to constitute a quorum to do business; but a smaller number may adjourn from day to day and may compel the attendance of absent members in such manner and under such penalties as the Council, by ordinance, may have previously prescribed.

Section 3: Repeal of Prior Charter Ordinance. The Charter Ordinance No. 12, duly adopted on August 9, 2007, and which was published and became effective as provided by law, and which exempted said city from the provisions of K.S.A. 15-106, as said statute relates to quorum requirements and provided substitute provisions which are now inconsistent with this Charter Ordinance be, and the same is hereby repealed.
